The Overture Marks may not be used in connection with any product or service other than as expressly permitted by Overture in writing, and may not be used in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits Overture, its parent and affiliated companies, the Site or any other product or service of Overture or its parent and affiliated companies. You gain no right to use any Overture Marks or those of any other entity by virtue of your use of the Site

From time to time, Overture may collect and use certain personally identifiable information and non-personally identifiable information about you for marketing purposes, including use in connection with Newsletters, Send-To-A-Friend services. By using this Site, you represent and agree that you have read and understood the Privacy Policy and consent to the use of your personal information by Overture and its affiliates and third party representatives, if any, in accordance with the terms thereof and for the purposes set forth therein.

By accessing, using or browsing this Site, you acknowledge and understand that you have read, understand, and agree to be bound by our Privacy Policy. If you do not agree with our Privacy Policy, do not use this Site. 11. USER SUBMISSIONS
Overture is pleased to hear from its customers and welcomes your comments regarding our products and services. These comments should only be submitted to one of the mailboxes available to users of the Site provided for that purpose. All remarks, suggestions, ideas, graphics, or other information communicated to Overture through the Site (collectively, the "Submission") will forever be the property of Overture. Overture will not be required to treat any Submission as confidential, and will not be liable for any ideas for its business (including without limitation, product or advertising ideas) and will not incur any liability as a result of any similarities between your Submission and any future Overture products, services or operations. Without limitation, Overture will have exclusive ownership of all present and future existing rights to the Submissions of every kind and nature, everywhere. Overture encourages the responsible use of the internet by children together with their parents and to that end, Overture does not collect or use any personally identifiable information submitted or posted to the Site from individuals under the age of 13, except in order to respond on a one-time basis to a specific request for information.

15. ASSIGNMENT
You may not assign your rights and obligations under this Site Agreement for any reason. Overture may assign its rights and obligations under this Site Agreement at any time. In the event Overture elects to assign its rights and obligations hereunder, Overture shall notify consumers either via email notice and/or written notice, as determined by Overture in its sole discretion.
16. DISCLAIMER OF WARRANTIES; LIMITATIONS OF LIABILITY.
YOU EXPRESSLY AGREE THAT USE OF THE SITE IS AT YOUR SOLE RISK. 18. MISCELLANEOUS
This Site Agreement, together with the Overture Privacy Policy sets forth the nature and extent of your relationship with Overture Films, LLC as it pertains to the Site. This Site Agreement will be binding upon and inure to the benefit of Overture and you, and Overture's successors and permitted assigns, if any. If any provision of this Site Agreement is determined to be invalid or unenforceable, such determination will not affect the validity or enforceability of any other provision of this Site Agreement. Any waiver of any breach or failure to enforce any provision of this Site Agreement will not be deemed a future waiver of such term or a waiver of any other provision. Any waiver of any provision of this Site Agreement will be effective only if it is in writing and signed by Overture and you. Nothing contained in the Site Agreement shall constitute, or enable the development of a joint venture, partnership or any other employee/employer or independent contractor relationship or any other commercial relationship (except as reseller and customer) between you and Overture. This Site Agreement shall be governed by the laws of the United States and the State of California, irrespective of California's conflict or choice of law rules. Any action arising out of or relating to this Agreement may be brought exclusively in the appropriate state or federal court in Los Angeles, California, and Overture and you irrevocably consent to the jurisdiction of such courts and venue in Los Angeles, California. This Agreement constitutes the entire agreement between Overture and you with respect to the subject matter of this Agreement. Those provisions of this Site Agreement, which by their nature should survive expiration or termination of this Agreement, shall survive such termination.
